AEP Energy Earth Day Raffle
Please read these rules before entering the AEP Energy “Earth Day Raffle” (the “Raffle”). By submitting an entry, you acknowledge that you have read and agree to be bound by these Official Rules and the decisions of the Sponsor and that you satisfy all eligibility requirements.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
Eligibility: The Raffle is open to all persons who, at the time of entry, are 18 years of age or older and who are legal residents of the United States residing in Ohio receiving electricity service from AEP Ohio, The Illuminating Company, Ohio Edison, Toledo Edison, Dayton Power & Light or Duke Energy Ohio. Employees, officers, and directors (including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of AEP Energy, Inc. (the “Sponsor”) and their affiliates, agencies, parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the Raffle are not eligible to participate or win the Prize (defined below). The Raffle is subject to all applicable federal, state and local laws, rules and regulations. Void outside of Ohio and where prohibited or restricted by law, rule or regulation. Entry in the Raffle constitutes your full and unconditional acceptance of these Official Rules (the “Official Rules”) and by the decisions of the Sponsor, which are final and binding in all respects.
How to Enter: The Raffle entry period begins at 12:01 AM Eastern Time (“ET”) on April 22, 2018 and ends at 11:59 PM ET on April 22, 2018 (the “Entry Period”). Limit of one (1) entry per eligible person throughout Entry Period. In case of multiple entries received from one person, only the first entry received from such household will be considered. There are two (2) ways to enter during the Entry Period: Entry form found at AEPenergy.com/raffle, and/or paper Entry Form provided at the AEP Energy booth. No other method of entry will be accepted.
Information Collected and Privacy: Entrants to the Raffle may be given the option to opt-outs of commercial emails and/or other communications from AEP Energy, Inc. Eligibility to participate in the Raffle is not dependent upon entrants opt-out to receive such emails. Any communications not opt-outed of to receive such emails and/or other communications will not impact any entrant’s chances of winning. By entering, entrants do agree to be called, mailed or emailed by AEP Energy with information related to the entrant’s entry.
Random Draw: All valid entries will be entered in the drawing. A random draw for the Prize, by a Sponsor representative, or other person designated by the Sponsor, will be held on or about April 30, 2018 from among all eligible entries received from each weekly period. All losing entries will not count for any and all future “Earth Day Raffle” drawings.
The potential winner selected in accordance with the above will be contacted by telephone and/or email at the telephone number and/or email address provided at the time of entry. If a potential winner cannot be reached within two (2) days of the first notification attempt or declines the prize, he/she will be disqualified, the Prize will be forfeited and, at Sponsor’s discretion and time permitting, an alternate potential winner may be selected at random from among remaining eligible entries. The decisions of the Sponsor, including the selection of the winner, are final and binding on all matters relating to the Raffle. Odds of winning depend on the number of eligible entries received.
Prize: There will be one (1) Prize available to be won, which is in the form of (1) 8 person COSI Family Pass. The face value of the pass is $200.00. The face value of the pass was calculated by $25 per person, per day, times 8 people. The pass is subject to separate terms and conditions imposed by issuer. The grand prize winner is fully responsible for any and all applicable federal, state and local taxes (including income and withholding taxes) and will be required to provide the Sponsor with a mailing address, and complete and submit a W-9 form to claim the prize. All costs and expenses associated with Prize acceptance and use not specified herein as being provided are the sole responsibility of the winner.
Prize Conditions: No substitution or transfer of prizes or cash redemptions permitted, except at the sole and absolute discretion of the Sponsor. The Sponsor reserves the right to substitute for any reason whatsoever the Prize (or any portion thereof) of comparable, or greater value, at its sole and absolute discretion.
Waiver of Liability/Publicity Release: By participating in the Raffle and submitting an entry, each entrant (A) agrees to
(i) be bound by these Official Rules, including all entry requirements, (ii) the decision(s) of the Sponsor and (iii) waive any and all claims against the Sponsor, COSI and each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Raffle, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Raffle or from the receipt, possession, use and/or misuse of the Prize (or any portion thereof) or any travel or activity that is related to the receipt or use of the Prize (or any portion thereof) and (B) acknowledges that (i) the Raffle is in no way sponsored, endorsed or administered by, or associated with COSI, and (ii) he/she is providing information to the Sponsor and not to Facebook, Twitter or COSI. By entering the Raffle, each entrant gives his/her express permission to be contacted by the Sponsor for Raffle purposes. By acceptance of the Prize, each winner authorizes the Sponsor and their respective designees to use in any related publicity, such winner’s name, photograph, image, any statements they may make regarding the Prize, city and state of residence, likeness and/or voice for advertising and promotional purposes worldwide in perpetuity and in any form of media now or hereafter devised worldwide (including the Internet), if the winner gives consent from AEP Energy’s Publicity Waiver.
By participating in the Raffle, you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Entrants agree that in any cause of action, in no event shall the Released Parties be liable for attorneys’ fees and/or experts’ fees and costs. WITHOUT LIMITING THE FOREGOING, THE RAFFLE, THE PRIZE, AND ALL MATERIALS PROVIDED IN THE CONTEST ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
General Raffle Terms and Conditions: The Released Parties are not responsible for stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, postage-due or garbled entries, transmissions, email or mail; or for lost, interrupted or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, or other connections including those through and/or by any website, availability or accessibility or miscommunications or failed computer, satellite, telephone, cable or wireless transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; failures or malfunctions of phones, phone lines or telephone systems, any error, omission, interruption, defect or delay in transmission, processing, or communication; non-delivery; misdirected, blocked, or delayed email notifications; printing, typographical or other errors appearing within these Official Rules, in any Raffle-related advertisements or other materials; or any other errors, problems or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, mail, typographical, printing or otherwise relating to or in connection with the Raffle, including, without limitation, errors or difficulties which may occur in connection with the administration of the Raffle, the processing of entries, the announcement of the Prize or in any Raffle-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Raffle. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Raffle or downloading materials from or use of the website.
Persons who tamper with or abuse any aspect of the Raffle or website or attempt to undermine the legitimate operation of the Raffle by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives or who are in violation of these Official Rules, as solely determined by the Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of the Raffle is unlawful and subject to legal action by the Sponsor and/or their respective agents. The Sponsor shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Raffle, and to resolve all disputes in their sole discretion. The failure of the Sponsor and Columbus Crew SC to enforce any term of these Official Rules shall not constitute a waiver of that provision. All disputes concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Sponsor in connection with the Raffle, shall be governed by, and construed in accordance with, the laws of the State of Ohio, without regard for conflicts of law doctrine, and all proceedings shall take place in Franklin County, Ohio.
The Sponsor reserves the right, in their sole discretion, to cancel, suspend or otherwise modify the Raffle (or any portion thereof) for any reason, including, but not limited to incidents where a virus, bugs, unauthorized human intervention, or other causes corrupt the administration, security, fairness, integrity or proper operation of the Raffle (or any portion thereof). In the event of cancellation, the Sponsor may elect to identify winner and award the Prize by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation.
Winner: For the name of the winner (available after April 23, 2018), mail a self-addressed stamped envelope to: AEP Energy “Earth Day Raffle” List of Winners c/o AEP Energy, P.O. Box 3489, Chicago, IL 60654. Requests for the name of the winner must be received by June 23, 2018.
